Military Excess Property Program (The 1033 Program)

The 1033 Program permits the Secretary of Defense to transfer, without charge, excess U. S. Department of Defense (DoD) personal property (supplies and equipment) to State and local law enforcement agencies (LEAs). This Program has allowed law enforcement agencies to acquire vehicles, weapons, computer equipment, tools, fingerprint equipment, night vision equipment, radios, tents and sleeping bags, photographic equipment, various clothing items, and more. All property is transferred on a first-come, first-serve basis. Property cannot be sold, leased, rented, exchanged, bartered, used to secure a loan, used to supplement the agency’s budget, or stockpiled for possible future use.

1033 Introduction/Guidelines

The 1033 Program permits the Secretary of Defense to transfer, without charge, excess U. S. Department of Defense (DoD) personal property (supplies and equipment) to State and local law enforcement agencies (LEAs). This Program has allowed law enforcement agencies to acquire vehicles, weapons, computer equipment, tools, fingerprint equipment, night vision equipment, radios, tents and sleeping bags, photographic equipment, various clothing items, and more.

• The requesting agency must be a government agency whose primary function is the enforcement of laws and whose officers are compensated and have powers of arrest and apprehension.
• Equipment transferred must have a direct application to the law enforcement agency’s arrest and apprehension mission.
• The property must be drawn from surplus property of the Department of Defense.
• The receiving agency is responsible for all costs associated with the property after it is transferred, as well as for all shipping or federal repossession costs.
• The recipient must accept the property on an as-is, where-is basis.
• All property is transferred on a first-come, first-serve basis.
• Property cannot be sold, leased, rented, exchanged, bartered, used to secure a loan, used to supplement the agency’s budget, or stockpiled for possible future use.
• Every 12 months participating agencies are mandated to certify their agency information and property books.

Participation in the 1033 Program

Participating agencies (LEAs) will receive a Department of Defense Activity Address Code (DODAAC), which allows the Law Enforcement Support Office (LESO) to track issued property. Additionally, LEAs are granted access to web-based applications which will allow them to search for and request equipment. Requests for excess DOD property by State LEAs must be approved by the State Coordinator and LESO.

Once property is received the LEA assumes responsibility and accountability for it. If the LEA desires to Transfer, Turn-In, or Dispose of the property, they must have approval from the State Coordinator and LESO.

Participation Documents

Agencies must complete and submit to the State Coordinator’s Office the following documents:

1. An application
2. State Plan of Operation

Contact the 1033 Program Manager to obtain the required participation documents. It is preferred that the completed documents be emailed to the 1033 Program Manager for processing. Agencies, however, may choose to mail the completed documents to:
